Ezeonwuka Urges Anambra Gov’t To Nullify C-of-O Erroneously Issued To Private University

Chief Rommy Ezeonwuka, Managing Director of Ranet Industries Ltd has called in the Ministry of Land, Anambra State to deregister the Certificate of Occupancy in relation to the company land erroneously issued to a Catholic priest in favour of Tansian University.

Ezeonwuka made the call in a letter to the Commissioner for Land entitled “Request For Deregistration of Certificate Of Occupancy (C of O) With File No. PAN 2893”

The businessman and managing Director of Rojenny Stadium Stadium, Oba is alleged the CoO issued to Sons Of Blessed Tansi in January 2017 was fraudulently obtained and based on a fake power of attorney.

He said the C of O PAN 2893, dated Aug. 10, 2017 must have been registered in error and should be deregistered because the land in question already had an existing C of O registered since April 1989.

Ezeonwuka who supported his letter with the search report and other relevant documents, said the land in question was documented as no. 60 in page 60 volume 1269 and No. 61, page 61 in volume 1269 on April 11, 1989.

He said under the Land Use Act of 1978, a Certificate of Occupancy is meant to be issued once for a particular plot of land adding that no plot of land should have double C of O.

Ezeonwuka also cited alleged irregularities in the documents which was used to build the file upon which the double C of O was extracted.

According to him, if a C of O is issued to a person while another person already holds a valid, existing right to the same plot, the latter is typically considered invalid, null, and void.

“There is also a consent judgment that further proves that the properties belong to me, a copy of the consent judgment is attached for ease of reference.

“We request that the Honourable Commissioner do the needful based on the fact that my property already had an existing C of O,” he said.

Speaking further, Ezeonwuka said there was a consent agreement between Ranent Industries and the founder of Tansian University, Very Rev. Msgn Joinbosco Akam which showed that the land was not in contention.

He said the judgment stipulated the terms and structure which Tansian University would pay him for using the property and wondered why some persons would want to hijack the property after the death of the founder.
